Acceptance of Terms
Welcome to KAP Film Village & Resort. These Terms of Service ("Terms") constitute a legally binding agreement between you ("Guest," "Client," "User," or "you") and KAP Entertainment & Hospitality Limited ("KAP," "we," "our," or "us"), governing your use of our website located at kapfilmvillageandresort.com and all services provided at or through KAP Film Village & Resort.
Please read these Terms carefully. By accessing our website, making a reservation, purchasing tickets, or using any of our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our services.
If you are making a booking on behalf of a company, organisation, or group, you represent and warrant that you have the authority to bind that entity to these Terms, and all references to "you" include that entity.
These Terms apply to all visitors, guests, clients, and users of our website and services, including but not limited to: accommodation guests, restaurant patrons, conference organisers, event attendees, film production clients, and experience participants.

KAP Film Village & Resort offers a comprehensive range of hospitality, entertainment, and production services:
Accommodation
Luxury rooms, suites, and chalets across multiple categories, offering world-class hospitality in a unique natural setting.
Dining & F&B
Multiple restaurant venues, bar facilities, private dining experiences, and in-room dining services for all guests.
Film Production
Dedicated film sets, production support facilities, equipment access, and crew accommodation for the entertainment industry.
Conferences & Events
State-of-the-art conference facilities, event planning support, audio-visual equipment, and catering services.
Experiences & Activities
Nature tours, cultural experiences, wellness services, adventure activities, and culinary experiences.
Online Services
Website booking portal, event registration, gallery viewing, blog content, and online enquiry management.
We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice. Where services are modified or discontinued after a booking has been confirmed, we will offer alternative arrangements or appropriate compensation.
Reservations & Bookings
3.1 Booking Confirmation
A reservation is confirmed only when you have received a written confirmation from KAP Film Village & Resort via email or other written communication. Verbal confirmations are not binding. All bookings are subject to availability at the time of confirmation.
3.2 Rates & Pricing
All published rates are in Nigerian Naira (₦) unless otherwise stated and are inclusive of applicable Value Added Tax (VAT) at the current statutory rate. Rates are subject to change without notice until a booking is confirmed. The rate applicable is the rate confirmed at the time of booking.
- Published rates are per room per night unless stated otherwise
- Breakfast inclusion varies by room category and rate type — please check your booking confirmation
- Additional services (spa, dining, activities) are charged separately unless included in a package
- Rates for public holidays and peak periods (Eid, Christmas, New Year, etc.) may differ from standard rates
- Group bookings (5+ rooms) and corporate accounts are subject to separately negotiated rates
3.3 Payment Terms
- Online bookings: Full payment is required at the time of booking to guarantee your reservation
- Direct bookings: A deposit of 50% of the total booking value is required within 48 hours of receiving a pro-forma invoice; the balance is due no later than 14 days before arrival
- Corporate accounts: Payment terms are governed by the corporate account agreement, typically 30 days net from invoice date
- Film production: A 30% deposit is required upon signing the production agreement; remaining payments as per the agreed schedule
- We accept payment by bank transfer, debit/credit card, and approved mobile payment methods
3.4 Check-In / Check-Out

3.5 Guest Identification
All guests are required to present valid government-issued photo identification (National ID, International Passport, or Driver's Licence) at check-in. Failure to provide valid identification may result in refusal of accommodation without entitlement to a refund.
Cancellation & Refund Policy
Our cancellation policy varies by booking type. All cancellation requests must be submitted in writing to reservations@kapfilmvillageandresort.com. Cancellations are effective from the date and time the written request is received.
4.1 Accommodation Cancellations

4.2 Non-Refundable Rates
Bookings made under a non-refundable rate plan are not eligible for any refund upon cancellation. Please confirm your rate type before completing your booking. Non-refundable bookings may be transferable to a future date subject to availability and payment of any rate difference.
4.3 Event & Conference Cancellations

4.4 Refund Processing
Approved refunds will be processed within 10–14 business days to the original payment method. Refunds are subject to applicable bank processing times. International wire transfer fees are borne by the guest.
4.5 KAP's Right to Cancel
KAP reserves the right to cancel a confirmed booking in exceptional circumstances including but not limited to: force majeure events, safety emergencies, property damage, government restrictions, or where a guest breaches these Terms. In such cases, we will provide a full refund of amounts paid or offer alternative dates at no additional cost.
Travel insurance recommended. We strongly recommend that all guests obtain appropriate travel insurance covering cancellation, medical emergencies, and loss of personal belongings. KAP is not liable for losses arising from events covered by travel insurance.
Film Production Terms
The following additional terms apply to all film, television, commercial, photography, and media production bookings at KAP Film Village:
5.1 Production Agreement
All film production bookings require the execution of a separate Production Location Agreement which supplements these Terms. The Production Location Agreement shall specify: production dates and times, permitted sets and areas, maximum crew size, equipment permitted, location fees, exclusivity arrangements, and any special conditions.
5.2 Production Permissions & Compliance
- All productions must hold valid permits from the relevant Nigerian regulatory bodies (National Film and Video Censors Board, National Broadcasting Commission where applicable)
- Productions must comply with all applicable Nigerian laws including labour laws, child protection laws, and broadcasting regulations
- Aerial photography and drone usage requires prior written approval and compliance with Nigerian Civil Aviation Authority (NCAA) regulations
- All talent, crew, and equipment must be covered by adequate production insurance prior to commencement
5.3 Location Fees & Additional Charges
- Location fees are quoted per day of principal photography and per day of prep/wrap
- Overtime beyond agreed production hours is chargeable at 150% of the hourly rate
- Any damage to property, sets, furniture, or grounds caused by the production company is charged at full replacement or restoration cost
- KAP Film Village reserves the right to have a representative present during all filming activities
5.4 Content Rights
KAP Film Village grants a non-exclusive, limited licence for production companies to feature images of our facilities in the completed production for the agreed distribution channels specified in the Production Location Agreement. KAP reserves the right to approve any marketing materials that prominently feature the KAP Film Village name or branding. KAP is entitled to one copy of the completed production for archival and promotional purposes, unless otherwise agreed.
5.5 Exclusivity
Exclusivity of film sets or the entire property may be arranged for an additional exclusivity fee. During non-exclusive bookings, KAP may have other guests on the property and operates as a functioning resort. Productions must accommodate the normal operation of the resort during non-exclusive periods.
Conference & Events Terms
6.1 Event Confirmation
All conference and event bookings are subject to a signed Event Order ("EO") which details the event specifications, agreed services, staffing requirements, F&B minimums, and financial terms. The EO must be signed and returned with the required deposit within 5 business days of issue to confirm the booking.
6.2 Minimum Spend
Conference and event bookings are subject to minimum food & beverage spend requirements based on the venue, day of week, and duration. Minimum spend commitments are specified in the Event Order.
6.3 Final Guest Numbers
Final confirmed guest numbers must be provided at least 72 hours (3 business days) before the event. KAP will cater for the confirmed number or 10% above, whichever is greater. Charges will apply based on the final confirmed number, regardless of actual attendance.
6.4 Decoration & External Suppliers
- External decorators and suppliers must be pre-approved by KAP management
- All decorations must be flame-retardant and comply with fire safety regulations
- Confetti, glitter, and similar materials require special approval and attract an additional cleaning fee
- External catering is not permitted except by prior written agreement
- External AV companies must provide evidence of their equipment's safety certification
6.5 Public Events
Clients organising public events (ticketed concerts, festivals, public exhibitions) are responsible for obtaining all necessary permits from relevant authorities (LASAA, local government, police). KAP reserves the right to review and approve all promotional materials that reference the KAP venue before publication.
Guest Conduct & House Rules
All guests and visitors are expected to conduct themselves in a manner that respects the comfort, safety, and wellbeing of other guests, staff, and the property. The following rules apply throughout the resort:
7.1 General Conduct
- Respectful and courteous behaviour toward all staff and fellow guests is required at all times
- Noise levels must be kept at a reasonable level; quiet hours are observed from 11:00 PM to 7:00 AM
- Smoking is permitted only in designated outdoor smoking areas
- Possession or consumption of illegal substances on the property is strictly prohibited and will result in immediate removal and notification of law enforcement
- Open flames (candles, bonfires, fireworks) require prior written approval from management
- Guests are responsible for all additional charges incurred by members of their party or visitors they have invited onto the property
7.2 Pool, Spa & Recreational Facilities
- Children under 12 years must be accompanied by an adult at all times in pool areas
- Swimwear is required in pool areas; guests in inappropriate attire may be asked to leave
- Glass items are not permitted in pool areas
- Spa bookings must be made in advance; cancellations require 4 hours notice to avoid a 100% charge
- Certain spa treatments may not be suitable for guests with specific medical conditions; please consult the spa team before booking
7.3 Dining
- Smart casual dress is required in all restaurant venues; excessively casual attire (flip-flops, beach shorts, vests) may not be permitted in fine dining areas
- Restaurant reservations are recommended for peak periods; walk-in guests are welcome subject to availability
- Alcohol service is in accordance with Nigerian licensing laws; KAP staff are entitled to request proof of age
- Outside food and beverages are not permitted in restaurant areas
7.4 Property Care & Damage
Guests are liable for the cost of repairing or replacing any property damaged, lost, or stolen during their stay. Any breakages, accidents, or damage must be reported to the front desk immediately. A pre-authorisation may be placed on your payment card to cover incidentals during your stay.
7.5 Right to Remove
KAP management reserves the right to ask any guest or visitor to leave the property who engages in conduct that is abusive, threatening, disruptive, or in violation of these Terms or Nigerian law. In such cases, no refund of unused accommodation or service fees will be made.
Website Use
8.1 Permitted Use
Our website is provided for your personal and commercial use in connection with engaging our services. You may access and use the website to browse our services, make enquiries, complete bookings, read our blog, and interact with our content.
8.2 Prohibited Activities
You must not use our website:
- In any way that is unlawful, fraudulent, or harmful to KAP or third parties
- To transmit unsolicited commercial communications (spam)
- To upload or transmit viruses, malware, or any other malicious code
- To attempt to gain unauthorised access to any part of the website or its server infrastructure
- To scrape, crawl, or systematically extract data from our website without express written consent
- To use automated tools (bots, scripts) to make bookings or interact with our systems
- To impersonate KAP, our staff, or other users
- In any manner that could damage, disable, overburden, or impair the website
8.3 Account Security
If you create an account on our website, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account at security@kapfilmvillageandresort.com.
8.4 Website Availability
We aim to maintain the availability of our website but do not guarantee uninterrupted access. We may suspend, withdraw, or restrict availability for business or operational reasons, and we will endeavour to provide reasonable notice where possible.
Intellectual Property
All content on this website — including but not limited to text, graphics, photographs, video, logos, icons, audio, software, and design — is the property of KAP Entertainment & Hospitality Limited or its licensors and is protected by Nigerian and international copyright, trademark, and other intellectual property laws.
9.1 Permitted Use of Content
You may:
- View and print pages from our website for your personal, non-commercial use
- Share links to our website pages on social media platforms
- Use our media kit materials (if provided) within the scope specified in the media kit
9.2 Prohibited Use of Content
Without our prior written consent, you must not:
- Reproduce, distribute, or commercially exploit any website content
- Modify or create derivative works from our content
- Remove any copyright, trademark, or proprietary notices
- Use the KAP Film Village name, logo, or trademarks in any manner that could imply endorsement or association without authorisation
- Frame or mirror our website on any other site
9.3 Photography on Property
Personal photography and social media sharing by guests is welcomed and encouraged. However, commercial photography, editorial shoots, or photography intended for advertising requires a location agreement and appropriate fees. By sharing content that features KAP Film Village publicly, you grant us a non-exclusive, royalty-free licence to reshare that content on our social media channels with appropriate credit.
User Content & Reviews
Our website may allow you to submit reviews, comments, photos, and other content ("User Content"). By submitting User Content, you agree to the following:
- You grant KAP a non-exclusive, royalty-free, worldwide licence to use, reproduce, display, and distribute your User Content on our website and marketing materials
- Your User Content is accurate and not misleading
- Your User Content does not infringe the intellectual property rights or privacy rights of any third party
- Your User Content does not contain defamatory, offensive, or illegal material
- You will not post fake or incentivised reviews
KAP reserves the right to remove, edit, or decline to publish any User Content that violates these Terms, applicable law, or that we deem inappropriate for any reason. We do not endorse User Content and are not liable for any content submitted by users.
Limitation of Liability
11.1 Disclaimer of Warranties
Our website and services are provided on an "as is" and "as available" basis. To the fullest extent permitted by Nigerian law, KAP disclaims all warranties, express or implied, including but not limited to: implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11.2 Limitation of Damages
To the fullest extent permitted by Nigerian law, KAP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of our services or website, even if we have been advised of the possibility of such damages.
11.3 Cap on Liability
Our total aggregate liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total amount you paid to KAP for the specific service giving rise to the claim in the 12 months preceding the claim.
11.4 Guest Property & Valuables
KAP provides in-room safe facilities for securing valuables. KAP accepts no responsibility for the loss, theft, or damage to guest property or personal effects unless such loss or damage is directly caused by the proven negligence of KAP staff. Guests are encouraged to use in-room safes and the hotel's safety deposit facility for valuables.
11.5 Health & Safety
KAP maintains all facilities to appropriate safety standards. However, guests participate in recreational activities (swimming, nature walks, adventure experiences, spa treatments) at their own risk. KAP will not be liable for injury, illness, or death arising from participation in activities where proper safety precautions and warnings were communicated.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable Nigerian law.
Indemnification
You agree to indemnify, defend, and hold harmless KAP Entertainment & Hospitality Limited, its directors, officers, employees, agents, contractors, licensors, service providers, and successors from and against any claims, liabilities, damages, judgements, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:
- Your violation of these Terms of Service
- Your use or misuse of our website or services
- Your violation of any applicable law or third-party rights
- Your negligence, wilful misconduct, or fraud
- Any User Content you submit to our website
- Damage to our property or injury to our staff or other guests caused by your actions or omissions
Force Majeure
KAP shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control ("Force Majeure Events"), including but not limited to:
- Acts of God (floods, earthquakes, storms, fires, epidemics, pandemics)
- Acts of war, terrorism, civil unrest, or government-imposed restrictions
- Strikes, labour disputes, or industrial action
- Power failures, internet outages, or infrastructure failures beyond our control
- Government orders, regulatory changes, or official embargoes
- National emergencies declared by Nigerian federal or state authorities
In the event of a Force Majeure Event affecting confirmed bookings, KAP will:
- Notify you as soon as reasonably practicable of the nature and anticipated duration of the Force Majeure Event
- Offer alternative dates for your booking at no additional cost (subject to availability)
- Issue a credit voucher for the full booking value, redeemable within 24 months, if alternative dates cannot be agreed
- Issue a full refund if neither alternative dates nor a credit voucher is acceptable to you and the Force Majeure Event renders the service permanently impossible to deliver
Governing Law & Dispute Resolution
14.1 Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles.
14.2 Informal Resolution
Before initiating any formal legal proceedings, we encourage you to contact us to resolve any dispute informally. Please contact our management team at legal@kapfilmvillageandresort.com. We will attempt to resolve your concern within 21 days of receipt.
14.3 Mediation
If informal resolution fails, the parties agree to attempt mediation through the Lagos Multi-Door Courthouse (LMDC) or the Institute for Chartered Mediators and Conciliators (ICMC) before proceeding to arbitration or litigation.
14.4 Arbitration
Any dispute arising from or in connection with these Terms that cannot be resolved through mediation shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act (as amended) 2023. The arbitration shall be:
- Conducted by a sole arbitrator agreed upon by both parties or, failing agreement, appointed by the Court
- Held in Lagos, Nigeria, in the English language
- Subject to Nigerian law
14.5 Jurisdiction
For matters not subject to arbitration, both parties submit to the exclusive jurisdiction of the courts of Lagos State, Nigeria.
Changes to These Terms
We reserve the right to modify these Terms of Service at any time. We will indicate the date of the most recent revision at the top of this page and, for material changes, we will provide additional notice:
- A prominent notice on our website homepage for 30 days following the change
- Email notification to registered users and guests with upcoming bookings who may be materially affected
Changes to these Terms take effect 14 days after publication unless earlier acceptance is required for new services or regulatory compliance. Bookings confirmed before a change in Terms remain subject to the Terms in effect at the time of booking, except where changes are required by law.
Your continued use of our website or services after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, please discontinue use of our website and contact us to discuss your existing bookings.
